Types of Adoption
The law pertaining to the adoption process can be broken down into essentially three separate categories:
- Adoption by a Step-Parent: If you are a parent who has remarried and you wish for your new spouse to legally adopt your son or daughter, the easiest route to accomplish this is to obtain the consent of the biological parent. If you can do so, the process will be relatively quick and should go smoothly. If the biological parent objects, however, the adoption can only proceed if the rights of the biological parent are terminated. Understandably, this will prolong the process and make it more difficult.
- Adoption by a Relative: As is the case with adoption by a step-parent, adoption by a relative can be a quick process or a lengthy one, depending on the circumstances involved. If one wishes to be considered a relative, they must be related within a certain number of degrees to the adoptee in question. Further, both biological parents will need to either consent to the adoption or have their rights terminated prior to the adoption proceeding.
- Adoption by Neither Step-Parent nor Relative: If neither parent is related to the child, adoption can be a lengthy process but certainly one that is well worth it. Parents wishing to adopt in this way will likely need to consult the services of an adoption agency to ensure that they qualify for the adoption. We would also note that, though it is far less common, in all of the above scenarios, it is legally possible to adopt an adult as well as a child. Though it is rare, it does happen.
